Terms of Service
The rules for using the facyliti.com website. Use of the Facyliti platform itself is governed by your subscription agreement.
1. Acceptance
These Terms of Service (“Terms”) govern your use of facyliti.com (the “Site”), operated by Facyliti, C-33, Sector 62, Noida, Uttar Pradesh 201301, India. By accessing the Site you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. [LEGAL REVIEW REQUIRED]
Use of the Facyliti platform (the product) is governed by a separate Master Subscription Agreement or order form; where those conflict with these Terms, they prevail.
2. Permitted use
You may browse the Site and download content for your internal business evaluation. You must not: (a) scrape, crawl or harvest data except as permitted by robots.txt; (b) attempt to gain unauthorised access to the Site, its servers or databases; (c) submit false, misleading or unlawful information or impersonate any person; (d) transmit malware or interfere with the Site’s operation; (e) use automated means to submit forms; or (f) reproduce or redistribute Site content commercially without our written permission.
3. Intellectual property
The Site, its design, text, graphics, logos (including the Facyliti name and “F” mark), software and content are owned by Facyliti or its licensors and protected by Indian and international IP laws. Third-party marks referenced on the Site belong to their owners; references do not imply endorsement. Whitepapers and articles may be shared in unmodified form with attribution and a link to the Site.
4. Forms, demos and communications
Information you submit through forms is handled per our Privacy Policy. Demo bookings, quotes and pilots are subject to written confirmation and a separate agreement; nothing on the Site is a binding offer. Any feedback or suggestions you send us may be used without obligation to you.
5. Content, accuracy and forward-looking statements
We try to keep Site content accurate and current, but it is provided for general information only and may contain errors or be out of date. 8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACYLITI AND ITS DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE SHALL NOT EXCEED INR 10,000. NOTHING LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW. [LEGAL REVIEW REQUIRED]
9. Indemnity

10. Privacy and cookies
Our Privacy Policy and Cookie Policy form part of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of India. Courts at Gautam Buddh Nagar, Uttar Pradesh have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence. Before litigation, the parties will attempt good-faith resolution for 30 days; unresolved disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, seat New Delhi, language English.
